1. The information we collect

We may collect and process:

• your name, business email address, telephone number and account details;
• information about your agency, acquisition interests, professional role and organisation;
• financial, operational and ownership information supplied for a valuation, sale process, buyer profile or transaction;
• messages, meeting details, documents and other information you choose to provide;
• payment, subscription and transaction records (we do not receive your full card number);
• technical and usage data, including IP address, browser, device, pages visited, referral source and cookie identifiers; and
• information from public sources, professional networks, referrals and our business partners.

If you give us information about another person, you must be authorised to do so and should direct them to this policy.

2. How we use personal data

We use personal data to:

• provide and administer the Agencies.co platform and advisory services;
• assess agencies, buyers and potential transactions, including indicative valuations;
• introduce sellers and buyers where authorised and manage a sale or acquisition process;
• operate accounts, subscriptions, payments, meetings and customer support;
• send service messages and, where permitted, relevant marketing communications;
• secure, monitor, troubleshoot and improve our services;
• measure website and campaign performance; and
• comply with legal obligations, prevent fraud and establish or defend legal claims.

We may create aggregated or anonymised information for research, benchmarking and service improvement. We do not use such information to identify an individual.

3. Our legal bases

Depending on the activity, we process personal data because it is necessary to perform a contract or take steps at your request, because we have a legal obligation, because you have given consent, or because it is in our legitimate interests to operate, secure and improve Agencies.co and facilitate relevant business opportunities. Where we rely on legitimate interests, we consider your rights and reasonable expectations.

You may withdraw consent at any time. This does not affect processing carried out before consent was withdrawn.

4. Confidential seller and buyer information

Enquiring about a sale does not make your agency public. We do not publish identifying seller information or share it with buyers without a separate basis or permission appropriate to the service you have requested. If you ask us to run a sale, valuation or matching process, we may disclose agreed information to vetted prospective buyers, advisers and transaction participants in line with that process and any applicable terms or confidentiality arrangements.

5. Who we share information with

We share only what is reasonably necessary with recipients such as prospective transaction parties and their professional advisers, our own advisers, regulators and authorities, and suppliers that help us provide the service. Current supplier categories include:

• Clerk for user authentication;
• Replit and associated cloud infrastructure for hosting, databases and file storage;
• Stripe for payments and subscriptions;
• Postmark for transactional email;
• Close and Kajabi for customer relationship and communication workflows;
• Calendly for meeting scheduling;
• Slack for internal operational notifications;
• Google, Meta, Hotjar and Metricool for analytics, advertising and website measurement; and
• YouTube when you choose to play embedded video.

These organisations may act as our processors or, in some circumstances, as independent controllers under their own privacy notices. We may also disclose information as part of a corporate sale, reorganisation or transfer of assets.

6. Cookies and similar technologies

We and our suppliers use cookies, pixels and similar technologies to keep the website functioning, remember choices, understand usage and measure or improve advertising. These technologies may collect device, browsing and referral information. You can restrict cookies through your browser settings, although parts of the website may then work differently.

7. International transfers

Some recipients process data outside the United Kingdom. Where required, we use recognised safeguards such as UK adequacy regulations, the UK International Data Transfer Agreement or the UK Addendum to approved standard contractual clauses.

8. How long we keep information

We retain personal data only for as long as needed for the purposes described above, including to provide services, keep appropriate transaction and accounting records, resolve disputes and meet legal obligations. Retention depends on the nature and sensitivity of the information and the relevant contractual or legal requirements. Transaction and financial records may be kept for up to seven years after the relevant relationship or process ends. We delete or anonymise information when it is no longer required.

9. Security

We use proportionate technical and organisational measures to protect personal data. No online service can guarantee absolute security, so please take care when choosing what to send electronically and contact us if you suspect unauthorised use of your account or information.

10. Your data protection rights

Depending on the circumstances, UK data protection law may give you rights to access, correct or erase your personal data; restrict or object to processing; receive certain data in a portable format; and withdraw consent. You may also object to direct marketing at any time.

11. Marketing

You can unsubscribe from marketing by using the link in the message or contacting us. We may still send non-marketing messages needed to provide a service or administer an account.

We may update this policy as our services or legal obligations change. The date at the top shows when it was last revised.
